“The Company” refers to Lowveld Waste & Refuse Services.
“The Customer” refers to the person, company, or entity renting the equipment or services.
“Equipment” refers to skips, waste bins, machinery (TLBs/Trucks), and any related apparatus supplied by the Company.
“Rental Period” is the agreed duration of hire, standardly set at 3 Days unless otherwise specified in writing.
2.1 Standard Term: The standard rental period for a skip is 3 (Three) Days.
2.2 Extensions: Any request to extend the rental period must be made at least 24 hours before the scheduled collection date. Additional daily rental rates will apply.
2.3 Collection Rights: The Company reserves the right to collect the equipment without prior notice once the agreed rental period has expired.
2.4 Access: The Customer grants the Company access to the premises at all reasonable times to deliver, inspect, or collect the equipment. If access is blocked (e.g., by a locked gate or parked vehicle) upon our arrival, a “Wasted Journey Fee” may be charged.
3.1 Loading Level (The “Water Level” Rule): Skips must NOT be filled above the rim.
Reason: It is illegal to transport an overloaded skip on public roads.
Consequence: If a skip is overloaded, the driver reserves the right to refuse collection until the excess waste is removed by the Customer.
3.2 Prohibited Items: The following items are strictly PROHIBITED in General Waste and Rubble Skips:
Asbestos.
Hazardous chemicals, paints, solvents, or oils.
Medical or biological waste.
Tyres (unless by special arrangement).
Batteries.
Penalty: If hazardous waste is found in a skip, the Customer will be held liable for all specialized disposal costs and potential environmental fines.
3.3 Fire & Damage: No fires may be lit inside the skips. The Customer is liable for any fire damage to the equipment while it is in their possession.
4.1 Payment Terms: All payments must be made on or before delivery unless the Customer holds an approved credit account with The KCS Group.
4.2 Accepted Methods: We accept EFT (Electronic Funds Transfer) and Cash on Delivery. Proof of Payment (PoP) may be required before the skip is offloaded.
4.3 Cancellation: Bookings cancelled less than 24 hours before the scheduled delivery time may incur a cancellation fee to cover administrative costs.
4.4 Overweight/Misuse Charges: If a skip booked for “General Waste” is loaded with heavy material (such as concrete or soil), the Customer will be liable for the price difference (Rubble Rate vs. General Rate) and any landfill weight surcharges.
5.1 Damage to Property: While every care is taken during delivery and collection, the Company is not liable for damage to driveways, pavements, grass, curbs, or underground pipes caused by the weight of the truck or the skip.
Responsibility: The Customer must ensure the ground is stable enough to support the delivery vehicle and a fully loaded skip.
5.2 Equipment Security: The Customer is responsible for the safety of the equipment while it is on their site. Any theft of or damage to the skip (e.g., graffiti, impact damage from machinery) will be charged to the Customer.
5.3 Indemnity: The Customer indemnifies the Company against any claims, losses, or damages arising from the use of the equipment on the Customer’s property.
6.1 Wet/Dry Rate: Unless specified as “Dry Rate” (fuel excluded), all machinery hire includes fuel and a dedicated operator (“Wet Rate”).
6.2 Operator Authority: The operator has the absolute right to stop work if they deem a task unsafe or likely to damage the machine.
6.3 Site Safety: The Customer is responsible for identifying and marking underground cables or pipes before excavation begins. The Company is not liable for damage to unmarked utilities.
These terms are governed by the laws of the Republic of South Africa. Any legal proceedings shall be held within the jurisdiction of the Magistrates Court of Mbombela (Nelspruit).
